        LHC asks power secretary to submit reply until 17th

        Hearing a petition seeking construction of Kalabagh Dam (KBD), Lahore High Court (LHC) Chief Justice Umar Ata Bandial on Thursday directed the water and power secretary to appear in person and file a reply of the federal government until October 17.

        The chief justice also expressed his concerns that the government was not showing seriousness for filing a reply on this project of public welfare.

        He said that the court had directed the federal government to submit a detailed written reply showing hurdles in construction of KBD and its failure for not bringing the matter before Council of Common Interest (CCI) but so far no reply had been submitted.

        AK Dogar, counsel for the petitioner, said the present leadership of the country did not want the construction of KBD and giving “lame excuses”. He requested the court to direct CCI to take up the issue itself.

        The CCI also submitted its reply and pointed out that the council itself could not decide any matter and there was a proper procedure for submission of cases to it. It also requested the court to issue directions to the Ministry of Water and Power or any provincial government for bringing up the matter before CCI. A lawyer, Feroze Shah Gilani, had moved the petition, submitting that former caretaker chief minister of Khyber Pakhtunkhwa and former WAPDA chairman Shamsul Mulk said on October 9, 2010, that KBD was not an issue of Punjab alone but a matter of the country’s survival.
